End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Bohdan Kontsedal ("Licensor") for the use of Monghoul ("Software"), a desktop MongoDB GUI client.

By installing, copying, or otherwise using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.

1. Definitions

  • "Software" means the Monghoul desktop application, including all updates, patches, and associated documentation.
  • "Free Tier" means the version of the Software available at no cost, with limited features and capacity.
  • "Pro Tier" means the version of the Software with all features unlocked, available through a paid license.
  • "License Key" means the unique key generated by PayPro Global upon purchase that activates the Pro Tier on a Device.
  • "Device" means a single computer (physical or virtual) on which the Software is installed.

2. Grant of License

2.1 Free Tier

The Licensor grants you a free, worldwide, non-exclusive, revocable license to install and use the Software on an unlimited number of Devices, subject to the feature and capacity restrictions of the Free Tier.

2.2 Free Trial

The Licensor offers a one-time 14-day free trial of the Pro Tier. During the trial:

  • All Pro Tier features are unlocked on a single Device
  • No payment information is required
  • The trial is limited to one per Device, identified by an anonymous device fingerprint
  • The trial cannot be restarted, extended, or transferred between Devices
  • After 14 days, the Software automatically reverts to the Free Tier
  • Starting a trial constitutes acceptance of this Agreement

2.3 Pro Tier — Subscription (Monthly / Annual)

Upon purchasing a subscription, the Licensor grants you a non-exclusive, non-transferable license to use the Pro Tier on up to 3 Devices simultaneously for the duration of your active subscription. You may deactivate the Software on one Device and activate it on another.

2.4 Pro Tier — Lifetime

Upon purchasing a lifetime license, the Licensor grants you a perpetual, non-exclusive, non-transferable license to use the Pro Tier on up to 3 Devices simultaneously. You may deactivate and reactivate on different Devices.

Update entitlement: Lifetime licenses include 2 years of updates from the date of purchase. After the update period expires:

  • The Software continues to function indefinitely with all Pro features enabled
  • You retain the last version released within your update period
  • New versions released after your update period require purchasing an update renewal or a new license
  • No functionality is removed from versions you already have

2.5 Device Limit

Each license permits activation on up to 3 Devices simultaneously. Devices inactive for more than 30 days may be automatically deactivated to free a slot when a new Device is activated. To use the Pro Tier on more than 3 Devices, you must purchase additional licenses.

3. Restrictions

You shall not:

  1. Copy, modify, or distribute the Software except as expressly permitted
  2. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except as permitted by applicable law
  3. Rent, lease, lend, sell, sublicense, or transfer the Software or your license to any third party
  4. Remove, alter, or obscure any proprietary notices, labels, or marks
  5. Use the Software to develop a directly competing product
  6. Circumvent, disable, or interfere with license verification, feature restrictions, or usage limits
  7. Share License Keys publicly or with unauthorized parties
  8. Use automated tools to generate, test, or brute-force License Keys

4. Ownership

The Software is licensed, not sold. The Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any rights to the Licensor's trademarks, service marks, or trade names.

5. Payment and Activation

5.1 Payment Processing

All payments are processed by PayPro Global (PayPro Global, Inc.), acting as the Merchant of Record. Your purchase is subject to PayPro Global's terms of sale and buyer protection policies.

5.2 License Activation

  • Pro Tier licenses are activated by entering a valid License Key in the App
  • Activation requires an internet connection to verify the License Key against our license server
  • Upon activation, an anonymous device fingerprint is registered to track device usage against the device limit
  • After activation, the Software periodically verifies subscription status on startup (for subscription plans only)

5.3 Subscription Renewal

Subscriptions renew automatically. You may cancel through the PayPro Global customer portal at any time. Cancellation takes effect at the end of the current billing period.

5.4 Grace Period

If a subscription payment fails, a 3-day grace period applies during which Pro features remain accessible. After the grace period, the Software reverts to the Free Tier.

5.5 Offline Use

The Software functions offline after initial activation. Subscription validation occurs on app startup when an internet connection is available. If the validation server is unreachable, the existing license state is preserved.

6. Data and Privacy

6.1 Local Storage

All user data (connections, queries, results, configurations) is stored locally on your Device in an SQLite database. The Licensor does not have access to this data.

6.2 Telemetry

The Software collects anonymous usage analytics by default. No personally identifiable information is collected. You may opt out at any time. See the Privacy Policy for complete details.

6.3 Credentials

Connection credentials (passwords, certificates, SSH keys) are stored in the local database on your Device. The Licensor recommends enabling full-disk encryption on your operating system to protect sensitive data at rest.

7. Updates

The Software may automatically check for and install updates. Updates may modify features, fix bugs, or address security vulnerabilities. The Licensor is not obligated to provide updates but may do so at its discretion.

Update entitlement by plan:

  • Monthly / Annual subscription — updates are included for the duration of your active subscription
  • Lifetime license — updates are included for 2 years from the date of purchase. After the update period, the Software continues to work with all Pro features, but new releases require an update renewal

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT IT WILL MEET YOUR REQUIREMENTS.

9. Limitation of Liability

IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, OR BUSINESS INTERRUPTION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE.

THE LICENSOR'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

10. Database Operations Disclaimer

The Software provides tools for querying, modifying, importing, exporting, and deleting data in MongoDB databases. You are solely responsible for all operations performed through the Software, including but not limited to:

  • Data modifications and deletions
  • Index creation and removal
  • Database and collection management
  • Bulk operations

The write protection feature is a convenience tool and does not guarantee prevention of data loss. Always maintain appropriate backups.

11. Termination

11.1 By You

You may terminate this Agreement at any time by uninstalling the Software and destroying all copies.

11.2 By Licensor

The Licensor may terminate this Agreement if you breach any of its terms. Upon termination:

  • Your license to use the Pro Tier ceases immediately
  • You may continue to use the Free Tier unless the breach warrants full termination
  • Your locally stored data remains on your Device

11.3 Survival

Sections 4 (Ownership), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Database Operations Disclaimer), and 13 (Governing Law) survive termination.

12. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations. The Software may not be exported or re-exported to countries or entities prohibited by applicable law.

13. Governing Law and Disputes

This Agreement is governed by and construed in accordance with the laws of Ukraine. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Ukraine, except where mandatory consumer protection laws of your jurisdiction provide otherwise.

14. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

This Agreement, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and the Licensor regarding the Software, superseding all prior agreements, understandings, and communications.
